    Man charged with manslaughter after gas station assault

    A 31-year-old man has been charged with killing a 23-year-old man during a road rage assault at a local gas station.

    Waltham man Timothy Scalisi is facing charges of manslaughter, and assault and battery causing serious bodily injury.

    He’s accused of killing Nicholas Dagostino, also of Waltham, at Woodside’s Service Station on Weston Street last month. Scalisi allegedly picked up Dagostino, and slammed him to the ground.

    Waltham Police responded to the gas station after a reported fight between two men near the parking lot entrance on May 27 at around 8:49 a.m.

    Upon arrival, police saw Dagostino sitting on the shop steps, rubbing his head. He told police he was driving his vehicle, a white box truck, in the left lane heading toward the Route 20 rotary near the gas station.

    He was trying to enter the parking lot, but it was partially blocked by another vehicle in front of him. That vehicle was later identified as Scalisi’s — a white Hyundai Tuscon.

    The men started arguing and got out of their vehicles. That’s when they began fighting, as Scalisi allegedly picked up Dagostino and “brought him violently to the ground,” according to the Middlesex DA’s office.

    Dagostino after the assault reported feeling nauseous. He was vomiting and confused before he was transported to the hospital, where he died two days later.

    He had suffered a brain bleed, and had a small fracture on the right side of the lower rear portion of his skull.

    Through surveillance footage, investigators were able to identify Scalisi as the defendant.

    Police continue to ask the public for help in the ongoing investigation — which is being conducted by the Middlesex DA’s Office, Waltham Police and Massachusetts State Police.

    Police are asking members of the public to review any video they might have, and to contact police if they saw or heard anything in connection with the incident.
